Question (Q-70)
Zaid died and left behind some property and buildings. He left behind four sons, three daughters and one wife. He gifted his house to his wife before he passed away and handed it into her possession. Please explain how the wealth he has left behind should be distributed?
Answer:
Note: Inheritance rules are complex and case specific. Therefore, one should refer specific circumstances to a qualified scholar for guidance in relation to the method of distributing the inheritance of any particular deceased.
In this situation, the house that Zaid gifted to his wife before his death belongs to her. The remaining wealth of Zaid will be distributed in the following way on the condition that the questioner is honest, in the absence of any obstruction to inheritance, so long as the only inheritors are those mentioned by the questioner, and after those matters have been fulfilled that take precedence like dowry, debt and bequests.
The wealth will be divided into 88 shares. Each of his three daughters will inherit 7 shares, each of his four sons will inherit 14 shares and his wife will inherit 11 shares. The sons will receive twice as much as the daughters based on the ruling of the Noble Qur’ān that the share of the son is equal to the share of two daughters. The calculation for this distribution is as follows;
| 8 x 11 = 88 | |||
| Inheritors | 4 Sons | 3 Daughters | Wife |
| Shares | 56 | 21 | 11 |
