Question (Q-72)
Zaid died and left behind one wife, two sons, four daughters, one grandson and two granddaughters who are the children of his deceased son. How will Zaid’s wealth be distributed amongst his inheritors?
Answer:
Note: Inheritance rules are complex and case specific. Therefore, one should refer specific circumstances to a qualified scholar for guidance in relation to the method of distributing the inheritance of any particular deceased.
| 8 x 8 = 64 Shares | |||||
| Relative | 1 Wife | 2 Sons | 4 Daughters | 1 Grandson | 2 Granddaughters |
| Shares | 8 | 28 | 28 | 0 | 0 |
It is stated in Al Fatāwā Al Hindiyyah, Volume 6, Page 498,
إن کان في أولاد الصلب ذکر فلا شيئ لأولاد الإبن ذکوراً کانوا أو أناثاً أو مختلطين
“If there is at least one male child of the deceased alive, then there is nothing for the deceased’s grandchildren regardless of whether they are grandsons only, granddaughters only or grandsons and granddaughters.”
However, if the inheritors give the grandson and granddaughters some money as a gift and out of goodwill, then this is very good.
Allah (تعالى) is Most Knowing.
