Question (Q-12):
I started my fast but then vomited during the day. I then opened my fast at that time as I thought vomiting invalidates the fast. I have now been informed that vomiting only invalidates the fast if one purposely vomits a mouthful. Is it necessary for me to only do Qadha (make up for my one fast that I mistakenly opened) or do I have to perform Kaffārah (pay a penalty) as well?

Answer with the Help of the Almighty:
If vomit comes out without the person purposely making it do so then the fast is not invalidated. If anybody invalidates their fast during the day assuming that vomit has invalidated it then only Qadhā (making up for that one missed fast) is necessary. It is stated in Al Fatāwā Al Hindiyyah;
ولو ذرعه القيء فظن أنه يفطره فأفطره لا كفارة عليه 1
“If vomit overcame a fasting person and he thought that vomit invalidates the fast therefore he invalidated it, there is no Kaffārah 2 upon him.”
It is stated in Bahār e Sharī’at; 3
“If a fasting person vomited and thereafter ate food assuming that his fast had been invalidated then only Qadhā is necessary upon him.”

The Kaffārah for missing fasts is the same as the Kaffārah for Dhihār (where a man describes his wife to be forbidden for him like his mother) mentioned in the first Verses of Sūrah Al Mujādilah which is
- freeing a slave
- if unable to free a slave then to fast for 60 consecutive days
- If unable to fast (due to a valid reason such as illness and old age) then feeding 60 poor people.
It is stated in the Hanafī text Badā’i As Sanā’i;
ولنا ما روي عن النبي صلى الله عليه وسلم أنه قال : { من أفطر في رمضان متعمدا فعليه ما على المظاهر } ، وعلى المظاهر الكفارة بنص الكتاب ، فكذا على المفطر متعمدا .
“We (i.e. the followers of the Hanafī school) derive proof from what is narrated from the Prophet (peace and blessings of Allah be upon him) that he said, “Whoever intentionally invalidates his fast in Ramadhān then upon him is that which is necessary upon the person who did Dhihār.” It is explicitly stated in the Holy Qur’an that Kaffārah is upon the person who did Dhihār so the same applies to the person who purposely invalidates the fast.”
