Question (Q-102)
Is it permissible to perform Qaḍā of Ṣalāh (make up for missed prayers) after Fajr time has started and after performing Ṣalāh Al-ʿAṣr?
Answer:
The Answer with the Help of the Almighty King, the Bestower.
So long as the makrūh (disliked) time does not enter i.e. the time for sunset and the time of sunrise, it is permissible to perform Qaḍā of Ṣalāh (make up for missed prayers) and to perform Sajdah Al-Tilāwah during the time of Fajr and after the performance of Ṣalāh Al-ʿAṣr.
It is stated in Al-Fatāwā Al-Hindiyyah,
يكره فيها النوافل وما في معناها لا الفرائض هكذا في النهاية والكفاية فيجوز فيها قضاء الفائتة وصلاة الجنازة وسجدة التلاوة كذا في فتاوى قاضي خان
“Nawāfil (Voluntary Prayers) and what are in the meaning of them are makrūh (disliked) during these times, not farā’iḍ (essential Prayers). This is how it is stated in Al-Nihāyah and Al-Kifāyah. So Qaḍā of missed Prayers, Ṣalāh al-Janāzah (Funeral Prayer) and Sajdah al-Tilāwah (Prostration for recitation) are permissible during these times.” This is how it is stated in Fatāwā Qāḍī Khān. (An example of Prayer which is in the meaning of Nawāfil are the Rakʿatayn (two units) performed after Ṭawāf)
It is stated in Durr al-Mukhtār,
بعد صلاة فجر وعصر لا يكره قضاء فائتة ولو وترا أو سجدة تلاوة وصلاة جنازة وكذا بعد طلوع فجر(ملخصا)
“After Fajr Ṣalāh and ʿAṣr, Qaḍā of missed prayers is not disliked nor is the Qaḍā of Witr or Sajdah al-Tilāwah and nor is the performance of Ṣalāh al-Janāzah disliked. The same is the case after Fajr starts.” (abridged)
