If someone misses Ta’awwudh and Tasmiyyah is it necessary to perform Sajdah As Sahw?

Question (Q-34)
If someone misses Taawwudh and Tasmiyyah is it necessary (Wājib) to perform Sajdah As Sahw (Prostration of Forgetfulness)?

Does Sajdah As Sahw become Wājib if a person recites Ta’awwudh and Tasmiyyah aloud in the Prayers that are to be performed with silent recitation (Sirrī Salāh i.e. Dhuhr and ‘Asr)?

Answer:
Sajdah As Sahw is not necessary if someone misses Taawwudh and Tasmiyyah, or recites them loudly in any of the quiet Salāh regardless of whether the recitation of the Holy Qur’ān within that Salāh is carried out loudly or silently. In fact, when performing Salāh alone, you would not have to perform Sajdah As Sahw even if you recited the Holy Qur’ān loudly in a Salāh in which recitation is carried out silently (Sirrī i.e. Dhuhr and ‘Asr). The same would apply if you recited the Holy Qur’ān silently in the Salāh in which the recitation is aloud (Jahrī Salāh i.e. Fajr, Maghrib and ‘Ishā).                                                                    .

It is stated in Al Fatāwā Al Hindiyyah, Volume 1, Page 139,

ولا يجب بترك التعوذ والبسملة

“Sajdah As Sahw does not become necessary by leaving Ta’awwudh and Tasmiyyah.”

It is stated in Al Fatāwā Al Hindiyyah, Volume 1, Page 142,

وإن جهر بالتعوذ أو بالبسملة أو بالتأمين لا سهو عليه كذا في فتاوي قاضي خان والمنفرد لا يجب عليه السهو بالجهر والإخفاء لأنهما من خصائص الجماعة هكذا في التبيين

“If he recited Ta’awwudh, Basmalah or Āmīn loudly then Sajdah As Sahw is not necessary upon him. This is what is stated in Al Fatāwā Qādhī Khān. Sajdah As Sahw is not necessary when a person praying alone recites loudly or recites silently because the ruling necessitating silent or loud recitation is specifically in regards to Jamā’ah (Congregational Prayer). This is what is stated in At Tabyīn.”
